When an investigator from the Orange County Sheriff’s office responded to a drive-by shooting, the last thing Chris Upchurch expected to find was a convicted felon who allegedly shot himself with his own gun.

Upchurch says Daniel Lee Cagle initially told the Sheriff’s Office that he was shot by a person in a red pickup truck, but was found to have shot himself. Cagle’s story placed him walking near 933 Spruce Pine Trail off Old Number 10 near the Orange County/Durham border where he says he was shot in the knee.

Cagle, who is a felon and registered sex offender, is recovering at Duke Hospital. After his release, Cagle will be taken into custody.

Cagle will have to appear in Orange County Superior Court the day after he is served with the warrants.
