By WCHL NewsThe News & Observer along with about 60 other media outlets are being subpoenaed by defense lawyers for Demario Atwater, the man facing the death penalty in the Eve Carson murder case.
The subpoena calls for all relevant newspaper articles, letters, editorials and copies of all radio and television broadcasts that covered the Eve Carson murder. It’s the latest strategy by the Atwater defense team to prove their client will not receive a fair trial in North Carolina and that the trial should be moved to Virginia. The subpoena also calls for a profile of the media’s circulation or viewing/listening audience.
Atwater is facing the death penalty on charges that include the first-degree murder of former UNC Student Body President Eve Carson. He also faces federal kidnapping and carjacking charges. The other defendant Lawrence Lovette, Jr. was a minor at the time of Carson’s death and is ineligible for the death penalty.
A hearing on the subpoenaed materials will be held Wednesday March 10th in Winston-Salem. This Thursday, UNC will dedicate a garden on Polk Place to the late student body president.
